David Burstyner heads Adley Burstyner’s group claims practice. He has been a litigator for 20 years and has worked on group claims for over a decade.

During that time David has acted for SMEs, entrepreneurs, private individuals of limited means, and some of the world’s largest companies. His cases have included high profile and pioneering group claims, shareholder/investor claims, franchise disputes, anti-trust/competition damages, tort claims (negligence and unlawful imprisonment), insolvency, misleading and deceptive conduct, and general commercial litigation. 

Before founding Adley Burstyner in 2016, David was based in The Hague, the Netherlands, working at Europe’s oldest litigation funder as Head of Collective Redress (as class actions are called in Europe), with responsibility for claims with an aggregate value exceeding EUR500m as well as a talented multi-disciplinary team. Before that David was a senior lawyer in one of Australia’s largest class action and major projects litigation teams.

David is commercial in outlook and believes that litigation is frequently an unwanted distraction for his clients, taking them away from their core business activity. He aims to alleviate that burden by taking the time to understand the significance of a dispute in the context of the client’s bigger picture and tailoring a strategy to address the client’s needs, whether it be aiming towards a commercial and practical solution giving priority to the client’s other business activities, engaging in an unrelenting fight to establish a precedent valuable to the client, or something in between.

To this end, group claim procedures allow access to remedies without the heavy investment of time and money that individual litigation often entails for plaintiffs.
